The Partner (Provisional) visa (subclass 309) is the first step towards a permanent Partner visa (subclass 100) that allows the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia temporarily. This visa permits you to live, work, and study in Australia while your permanent Partner visa application is being processed, travel to and from Australia as many times as you want, attend free English language classes if you’re eligible, and apply for access to Medicare.

  • Be in a genuine relationship with your spouse or de facto partner who is an Australian citizen, permanent resident or eligible New Zealand citizen
  • Have your spouse or de facto partner sponsor you
  • Be outside Australia when you apply for this visa. Family members who apply with you must also be outside Australia.

The Partner (Migrant) visa (subclass 100) enables de facto partners or spouses of Australian citizens, permanent residents, or eligible New Zealand citizens to relocate to Australia permanently. Typically, this visa is granted to people who hold a temporary Partner visa (subclass 309).

Eligibility Requirements

To be eligible for the Partner (Migrant) visa (subclass 100), you must:

  • Hold a temporary Partner (Provisional) visa (subclass 309) or Dependent Child visa (subclass 445)
  • Be in a genuine and ongoing relationship with your partner
  • Meet visa and relationship criteria:
  • Hold a Partner (Provisional) visa (subclass 309) or Dependent Child (subclass 445) visa
  • Have held the combined 309 and 100 visas for at least two years, unless you were in a long-term relationship or your sponsor held a specific visa before you applied
  • Continue to meet the relationship criteria, which include being married or in a de facto relationship, having a genuine and ongoing relationship, living together or not living permanently apart, and being mutually committed to a shared life, excluding other partners
  • Meet health and character requirements
  • Have no debts owed to the Australian government or have arranged to pay debts back
  • We may not grant this visa if it is not in the best interests of an applicant under 18
